Canadian Gambling Laws by Province: Who Regulates What in 2026

How gambling is regulated in Canada — the Criminal Code, provincial monopolies, the licensed markets in Ontario and Alberta, Kahnawake, legal age by province…

Updated 5 Sep 2026Section Canadian Gambling Laws5 min read

The short version. Gambling in Canada is regulated province by province, not federally. Ontario has run an open licensed market since April 2022 through the AGCO and iGaming Ontario; Alberta opened its own regulated online market in 2026 under the AGLC. Elsewhere the only legal operator is the provincial lottery corporation. Playing on an offshore site is not an offence for the player.

We are an independent guide, not an operator. Offers are shown as published by the operator for Canadian players and change without notice — always read the terms on the casino site. 19+ (18+ in AB, MB and QC). Help: ConnexOntario 1-866-531-2600.

The Criminal Code prohibits gambling in general terms and then hands the exceptions to the provinces, which is why the map looks the way it does. A province may "conduct and manage" gambling itself — that is the PlayNow, Loto-Québec, Atlantic Lottery and PlayAlberta model — or it may license private operators, which so far only Ontario and Alberta have done.

The three regimes side by side

Age and tax

The legal age is 19 in most of the country and 18 in Alberta, Manitoba and Quebec. Gambling winnings of a recreational player are treated as a windfall and are not taxable income; the exception is a player whose gambling is carried on as a business, which is a narrow and fact-specific test.

What this means in practice

A Canadian player is not committing an offence by holding an account with an offshore casino, and enforcement in this country has always been aimed at operators rather than at players. The real difference between a locally licensed site and an offshore one is not legality for you — it is who you can escalate to when a withdrawal is refused.
